Fire on the Marktain: David Mark's political son, Ezekiel Adaji fails to defend second term victory in court

The case filed by the All Progressives Candidate For Otukpo / Ohimini Federal Constituency in the just concluded elections Chief Nelson Alapa against Hon Ezekiel Adaji of the Peoples Democratic Party continued today in makurdi hearing the defence of the Constituency collation officer which indicted both the 1st and 2nd respondents. Counsel to Hon Adaji Bar. Ken Ikonne asked to present 4 witnesses to start with one Mr Ote Ikwu.

 In a swift objection, Counsel to Chief Alapa Bar. Oba Maduabuchi argued that counsel to Hon Adaji had filed to amend his reply and in that reply Mr oteh ikwu who now appears as first witness was earlier to dropped.

 Saying When an amendment is made, what existed before becomes extinguished. But Ikonne maintained his position quoting order 17 rule 3 of the high court civil procedure rules. Which to him complies with the process. 

Asked the court to dis countenance the objection. Counsel to inec, Barr Ibu aligns himself to the position of Counsel Chief Alapa and says it is a very delicate issue at stake and asked the Judge to use his discretion in the matter but has to be very careful. 

Responding, Barr. Oba quoted rule 54 of the election tribunal rule to support his objection saying you can only resort to the federal high court rules only when no provision is made in the elections tribunal rules referring Ikonne's motion as a fatal and grievous error that may affect even the judge. 

Ikonne therefore withdrew the witnesses and abide by the evidence and statements of Chief Alapa and also accepted that he has no further defence to make. The judge then granted the application and withdrew the witnesses including Hon Adaji who was meant to defend and adjourned the case to August 27th 2015 for hearing of address. 

This development is coming few days after Adaji's godfather, David Mark was disappointed by his witnesses at the tribunal in Makurdi.
