Otukpo/Ohimini: Alapa, Adaji await judgment

The appeal filed by the All Progressives Congress Standard bearer for Otukpo / Ohimini Federal Constituency in the last general elections Hon Nelson Alapa came up for hearing in makurdi.

 Presenting his brief Counsel to Hon Alapa Barr Oluwole complained about a motion filed by INEC which did not have the statutory legal practice seal referring to it as incompetent. He further prayed that the court rules in favour of his client by setting aside the judgement of the tribunal on the basis that documents tendered were admitted and wondered why his clients witness statement will be referred to as hearsay. 

 In a preliminary objection, Counsel to INEC, Barr Ibiu urged the court to strike out the appeal on grounds of incompetence. Reacting to the complaint made by counsel to Hon Alapa on INEC's non compliance with electoral rules he said the electoral rules are directory not mandatory hence it is of no consequence for the returning to not to have signed the altered results sheets. 

 On his part, counsel to Hon Adaji Bar Ken Ikonne aligns with counsel to inec in asking the court to strike out the appeal sighting same reasons as INEC. The case has however been reserved for judgement on a date to be communicated to parties.

 Speaking to newsmen shortly after the sitting, Hon Nelson Alapa said all that needed to be done within the ambit of the law has been done and it is now left for the judges to determine.
